We maintain consistently high levels of best practices in our processing of your personal information while being compliant with all applicable laws.

This privacy policy (“Policy”) has been compiled to serve Users,  clients, visitors, Community Channel Partners, business associates, etc. who access, view or use the Zuari Infra App (“App”) and/or the website www.zuariinfra.com (“Website”) owned and operated by Zuari Infraworld India Limited.

This Policy governs the access, collection, usage, handling, storage and disclosure of your personal information irrespective of the fact that you directly approached us or through one of our channel partners or business associates or using the App and /or the Website, this Privacy Policy applies comprehensively to all interactions. It also describes the choices available to you regarding our use and processing of your personal information and how you can access and update this information on the App and /or the Website. This Policy is intended to assist you in making informed decisions about your personal information when using the App and /or the Website.

Definitions

“Data Fiduciary” means any person who alone or in conjunction with other persons determines the purpose and means of processing of personal data;

“Data Principal” means the individual to whom the personal data relates and where such individual is— (i) a child, includes the parents or lawful guardian of such a child; (ii) a person with disability, includes her lawful guardian, acting on her behalf;

“Data Processor” means any person who processes personal data on behalf of a Data Fiduciary;

“Personal information” means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such a person. This means that personal information can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual.

“processing” in relation to personal data, means a wholly or partly automated operation or set of operations performed on digital personal data, and includes operations such as collection, recording, organization, structuring, storage, adaptation, retrieval, use, alignment or combination, indexing, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction;

Roles

Zuari acts as a Data Fiduciary under the DPDP Act.

Users of the App and /or the Website are Data Principals.

Salesforce (Business Name: Salesforce.Com India Private Limited having its registered office at Third Floor, Torrey Pines, Embassy Golf Links Business Park, Varthur Hobli, Challaghatta Village, Bengaluru Urban, Karnataka, 560071) shall act as Data Processor and all the data collected by Zuari will be stored in servers maintained by the Data Processor.

What personal information do we collect, how we collect and how we use it?

User provided information – We collect and maintain the personal information that you voluntarily enter through the online form published on the App/Website, when you accept the Terms of Use of the App/Website, participate in surveys, contact us for help, or otherwise enter information on the App/Website during its use. When entering information on the App/access the Website, you may be asked to enter the following, for us to register you on the App help you with your experience of the App/website, to improve the App/Website, and to contact you and respond to your information requests:

  • Individual – Name, age, sex, demographic information, email address, mailing address, phone number, RERA No., RERA Validity.
  • Company – Company name, Company Head Name, Company Owner Name, Company Website, Company Email, Company Head Email, Company Owner Email, Company Head Contact No., Company Owner Contact No., Company Address, Company GST No., Company PAN Card No., Company RERA No., RERA Validity.
  1. KYC Data – Aadhar, PAN card, Passport
  2. Usage data – Team strength, Active medium, Board resolution and Authorization letter.

Personal information will be used by us for our internal business purposes and analysis, including administering your account, registering and providing you with access to the App/Website, rendering services to you, responding to your queries, fulfilling your relevant requests and sharing relevant property listings with you.

By voluntarily providing us with your personal information for the purpose as set out above, you are consenting to our collection, use, handling, processing and disclosure of it in accordance with this Policy.

Other Information – We may also collect certain other information, such as device ID, device make/model, IP address, geographical location (when enabled),browser type, operating system, page views, website navigation, timing and frequency of use of the App, marketing preferences, name of your  wireless  carrier, other  data  relating  to  malfunctions  when  you  use the  App/Website. We use this information purely for analytics and research purposes and to ensure the security of our App and/or website. The App/Website may store such information itself, or such information may be included in databases owned and maintained by our affiliates, agents or service providers. The App/Website may use such information and pool it with other information to track, for example, the number of transactions that are affected through the App/Website, the number of messages you send and receive, the total number of Users of the App/Website, the domain names of our visitors’ Internet service providers, and how our Users use and interact with the App/Website. Also. in an ongoing effort to better understand and serve the Users of the App/Website, the App/Website may conduct research on its customer demographics, interests and  behavior  based on the personal information and other information provided to us. This research may be compiled and analyzed on an aggregate basis. App/Website may share such aggregate data with its affiliates, agents and business partners, but this type of aggregate information does not identify you personally. App/Website may also disclose aggregated user statistics in order to describe our services to current and prospective business partners and to other third parties for other lawful purposes.

Cookies – Cookies are small files transferred to the hard drive of your device that enable us to recognize your browser and capture and remember certain information. Withdrawal of consent will not affect processing already carried out lawfully and may result in limited access to certain features.

In the event you choose not to provide us with your consent or withdraw the consent earlier provided, the services may no longer be available to you.

Retention of your personal information

Your personal information shall not be retained for longer than is necessary for the purposes for which we collect them, unless otherwise required for the purposes of fulfilling any legal, regulatory, accounting or reporting obligations. Zuari ensures that the Data Processor engaged by it, shall implement security safeguards that are no less stringent than those adopted by Zuari.

While Zuari follows industry-standard practices, Data Principals acknowledge that no method of transmission or storage of data is completely secure.

Disclosures to third parties

  • The App/Website uses the personal information you provide in a manner that is consistent with this If you provide us your personal information for a certain purpose, we will limit the use of the personal information so provided for the purpose for which it was provided. For instance, if you contact us by email or other messaging means, we will use the personal information you provide to answer your question or resolve your problem, or if you confirm  a transaction  using the  App/Website, we  will  use the financial data you provide to consummate the transaction. Also, if you provide personal information in order to obtain access to the App/Website, we will use your personal information to provide you with access to such services and to monitor your use of such services.

The use of App on behalf of children under the age of 18 years shall be subject to request by the parent and verifiable consent provided by the parent.

The use of App on behalf of persons with disability as defined under Rule 11 (2) (d) of the DPDP Rules, shall be subject to request by their lawful guardian and verifiable consent provided by the lawful guardian.

INDEMNITY AND LIMITATION OF LIABILITY

You agree to indemnify and hold harmless the Company, its affiliates, directors, employees, and service providers from and against any and all claims, losses, liabilities, damages, costs, etc., (including reasonable legal fees) arising out of or in connection with:

Your unauthorized disclosure or processing of personal data belonging to third party without having any lawful authority to do so, including sharing of information by impersonation.

Your failure to comply with applicable laws and regulations concerning Personal Data.

Any claims brought by a third party arising from any act of omission, commission and/or negligence on your part related to the use of our Services, products, Website and the App.

GOVERNING LAW & JURISDICTION

This Privacy Policy shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or in connection with this Policy, including its interpretation, validity, etc. shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
